£60,000 for Delayed Diagnosis of Basal Cell Carcinoma

15th July 2024 – Our client Mrs H experienced a number of skin problems from the mid-1990s and these necessitated regular check-ups for skin cancer.

In 2014, she had a small lesion on her nose checked by Dr David Fish, Consultant Histopathologist who reported that it was a trichoepithelioma when it was in fact the early stages of Basal Cell Carcinoma (BCC).

Unfortunately, she did not then receive her BCC diagnosis until some 7 years later when the tumour was much more advanced.

Because of this delay, Mrs H had to endure more invasive surgery and extensive reconstruction instead of what should have been a single stage procedure. Her life was greatly disrupted by multiple reconstruction procedures and she has been left with a worse functional and cosmetic outcome.

Mrs H instructed Fairweathers Solicitors LLP to investigate what happened and our expert evidence identified the above the breach of duty and all of the resultant problems.

After initially dragging their heels, Mr Fish’s insurers eventually admitted breach of duty and then negotiated a settlement in the sum of £60,000.

Stephen Evans the Solicitor with conduct of this matter commented:- “One of the features of this case is that Mrs H had to endure the painful reconstructive surgery on her own during lockdown. This case is an illustration that simple mistakes can have devastating consequences. I wish Mrs H all the best now that her case has reached a successful conclusion”.
