
3rd February 2026 – Our client Mr J instructed Fairweathers after becoming seriously ill with pulmonary fibrosis caused by his GP’s failure to stop his long-term nitrofurantoin treatment.
Mr J experienced worsening respiratory symptoms whilst on the medication and the Chestnut Surgery, Sittingbourne, failed to request an urgent chest x-ray and referral to the respiratory team until it was too late.
After further medical investigations, Mr J was diagnosed with pulmonary fibrosis with Usual Interstitial Pneumonia.
The symptoms were life changing and although comfortable at rest Mr J was only able to speak in short sentences due to breathlessness. He also became oxygen dependent.
Fairweathers obtained expert GP evidence confirming breach of duty and a Respiratory Expert was instructed to report on causation, condition and prognosis.
Thereafter, a Letter of Claim was sent to the Chestnut Surgery and although there were initial discussions about settlement they were not backed up with meaningful action by the GP surgery’s representatives.
Therefore, Court proceedings were issued which opened the way for Mr J to receive an initial £200,000 interim payment whilst waiting for final settlement.
After an exchange of offers at the end of 2025 settlement was agreed in the sum of £660,000.
